We are pleased to offer you our PIXFOOD™ Services. We want to reassure you that we are committed to safeguarding your privacy whenever you use or access our Services. The purpose of this Privacy Policy is to inform you about how we may collect, use, share, and keep information about you and the choices that are available to you as a user of the Services.

This Privacy Policy applies to all of the Services, as defined below, regardless of the platform or device upon which you visit, use or access the Services.

The Services are not intended for children under 13 years of age. We do not knowingly solicit data online from, or market online to, children under 13 years of age.

We may change our Privacy Policy from time to time, at our sole discretion and without notice to you. Since we may change, modify or edit this Privacy Policy at our discretion, and without notice to you, we recommend that you check the current version available from time to time. If we make changes to this statement, we will update the “Effective Date” at the top of this page.

A. Definitions

Aggregated Information: data or information relating to multiple people which has been combined or aggregated. Aggregated Information includes information that we create or compile from various sources, including certain data from Cookies and Similar Technologies or Device Information.

Business Partners: any third parties with whom we conduct business and have a contractual relationship.

Cookies and Similar Technologies: a cookie is a small data file that a website transfers to your computer's hard drive. We may place cookies when you use the Services or register for certain services. If you accept the cookies used in connection with the Services, websites that are “powered by” another company on our behalf, or websites where our ads appear, you may give us access to information about your interests. We may use that information to personalize your experience. Similar technologies such as web beacons, pixels, gifs, and tags also do the same thing. We use the term Cookies and Similar Technologies in this Privacy Policy to refer to all technologies that collect information in this way.

De-identified Information: data or information used in a way that does not identify you to a third party. We often derive De-Identified Information from Personal Information. It includes information that we may collect from various sources or certain data from Cookies and Similar Technologies.

Device Information: data or information about the device you are using to access the Services, including what type of device it is, what operating system you are using, your device settings, unique device identifiers, and crash data. Whether we collect some or all of this information may depend on the type of device you are using or the setting on your device. Information provided to us from your device may depend on the type of device you are using, e.g., a computer, tablet, smartphone Mac, PC, iPhone or Android phone. We recommend that you consult the manufacturer or settings of your device to determine the information we can obtain from your particular device.

IMP Digital AB (referred to as “we”, “our”, or “us”): owner of all rights, title and interest in and to the Services, as well as the intellectual property associated with the Services.

IP Address: a number assigned to a device when connecting to the Internet.

Online Information: data or information collected in connection with the Services that are online, i.e., collected via your use of the Internet, as well as on third-party websites, apps or applications related to cooking.

Personal Information: information that can identify a person, such as name, address, telephone number, and email address.

Services: our services provided in connection with the PIXFOOD™ trademark, including mobile services, web site, applications and any software provided on or in connection with any of our services.

Service Providers: any vendor, third party and/or company that performs business operations on our behalf, such as communications services (email, direct mail, etc.), marketing, data processing, servicing, or ad management.

Targeted Advertising: ads we, or our Service Providers or Third-Party Ad Servers, display on third party websites based on the preferences or interests inferred from data collected from a particular computer or device regarding web viewing behaviors over time and across different websites.

Third-Party Ad-Servers: companies that provide the technology to place ads on websites (and apps) and track how ads perform. These companies may also place and access cookies on your device. The information they collect from our websites is in a form that does not identify you personally.

B. Privacy Policy Statements

What information does this Privacy Policy cover?

This Privacy Policy describes how we (and our Service Providers) may collect, use, share, and keep information that we get about you online. We gather Online Information if you:

(i) Visit or use or access the Services;
(ii) Receive or reply to electronic communications from us;
(iii) View or click on our ads or other online content; and
(iv) Interact with us through social media websites and other websites and apps.

In this Privacy Policy, we also explain how we may combine Online Information with Other Information and how we then use the combined information.

What information do we collect online and how do we collect it?

Sometimes you give information directly to us (or to our Service Providers). For example, you might give us your name, email, address, phone number, or date of birth when you:

(i) Register or sign-up to use and access the Services;
(ii) Use or access the Services by signing-in or logging-in using your account with a third-party (such as a third-party social network or application);
(iii) fill out an online form or survey;
(iv) register, log into or update the settings on your account using the Services;
(v) enter a competition or register for a marketing offer; or
(vi) buy something through the Services.

Whether we collect Device Information, or other information through Cookies and Similar Technologies, we want you to know that we (and our Service Providers or Third-Party Ad-Servers) may collect information about:

(i) the device you use to access the Services (e.g., Device Information);
(ii) the IP Address and information related to that IP Address (such as domain information, your internet provider and general geographic location);
(iii) browsing history on our websites or apps (such as what you search for, the pages you view, how long you stay, and how often you come back);
(iv) how you search for any of the Services, from which website you came from, and which of our Business Partners’ websites you visit;
(v) which ads or online content from us and our Business Partners you view, access, or click on;
(vi) your browsing activities over time and across other websites, following your visit to one of our websites or apps;
(vii) whether you open our electronic communications and which parts you click on; and
(viii) the location of your computer, tablet, smartphone, handheld or mobile device (for example, when you use our mobile websites or apps to register to receive location-based content).

We (and our Service Providers or Third-Party Ad-Servers) may also collect information made publicly available through third-party platforms (such as online social media platforms), through online databases or directories, or that is otherwise legitimately obtained. This information may be governed by the privacy notice(s) provided by the third-party at the time of collection.

How do we use the information we collect about you?

We may use Online Information we collect about you on its own or combine it with Other Information to:
(i) deliver Services, including to:
a. recognize you when you return to our websites or use our apps;
b. complete transactions;
c. tell you about updates to the Services or your accounts, products, and services;
d. update you about new features and benefits of the Services
e. answer questions and respond to your requests made through our websites or apps and through third-party websites (including social media);
f. use the location of your mobile device for location-based services that you may request;
g. determine how to best provide Services to you and manage your accounts, such as the best way and time to contact you;
h. improve our websites and make them easier to use;
(ii) advertise and market the Services – and the services of our Business Partners – including to:
a. present content that is tailored to your interests, including Targeted Advertising;
b. send or provide you with ads, promotions, and offers;
c. analyze whether our ads, promotions, and offers are effective;
d. help us determine whether you may be interested in new products or services, including the Services;
(iii) advertise and market the Services – and the services of our Business Partners – including to:
a. better understand our users, customers and visitors;
b. allow you to give feedback by rating and reviewing our products and services and those of our Business Partners;
c. produce data analytics, statistical research, and reports;
d. review and change our products and Services;
(iv) manage fraud and security risk, including to:
a. detect and prevent fraud or criminal activity;
b. safeguard the security of your information;
(v) Other ways as required or permitted by law or with your consent.

How we treat your Personal Information

You should be aware that some Online Information is also Personal Information. We do not share Personal Information with anyone except as described below. We may share Personal Information as required or as permitted by law, such as:

(i) with regulatory authorities, courts, and governmental agencies to comply with legal orders, legal or regulatory requirements, and government requests;
(ii) with our Service Providers, regulatory authorities, and governmental agencies to detect and prevent fraud or criminal activity, and to protect the rights of IMP Digital AB or others;
(iii) with our Service Providers who perform services for us and help us operate our business (we require Service Providers to safeguard Personal Information and only use your Personal Information for the purposes we specify);
(iv) with partners with whom we jointly offer or develop products and services (but they may not use your Personal Information, e.g., in particular your email address, to independently market their own products or services to you unless you consent that they can do so);
(v) in the context of a sale of all or part of the Services or IMP Digital AB; or
(vi) for specific products or services, when you have given your consent.

How we handle Aggregated Information and De-identified Information

Aggregated Information or De-identified Information does not identify you individually. This information helps us to analyze patterns among groups of people. We may share Aggregated Information or De- identified Information in several ways, for example:

(i) for the same reasons as we might share Personal Information;
(ii) with Business Partners to help develop and market products or services and present targeted content and Targeted Advertising;
(iii) with Business Partners to conduct analysis and research about customers and website visitors; or
(iv) with Third-Party Ad-Servers to place ads (including ads of our Business Partners) on various websites and apps, and to analyze the effectiveness of those ads;

How do we keep and safeguard your information?

We use administrative, technical, and physical security measures to protect your Personal Information. These measures include computer safeguards and secured files and facilities. We take reasonable steps to securely destroy or permanently de-identify Personal Information when we no longer need it or when you delete your account. We will keep your Online Information only as long as we must to deliver the Services, unless we are required by law or regulation or for litigation and regulatory investigations to keep it.

However, despite these efforts, no security measures are perfect or impenetrable and no method of data transmission can be guaranteed against any interception or other type of misuse. We will make any legally required disclosures of any breach of the security, confidentiality, or integrity of your unencrypted electronically stored personal data (as defined in applicable state statutes on security breach notification) to you via email or conspicuous posting on the website (www.pixfood.com), or as otherwise required by law, in the most expedient time possible and without unreasonable delay, insofar as consistent with (i) the legitimate needs of law enforcement or (ii) any measures necessary to determine the scope of the breach and restore the reasonable integrity of the data system.

Where do we keep your information?

Your information may be transferred to and maintained on computers located outside of your state, province, country or other governmental jurisdiction where the privacy laws may not be as protective as those in your jurisdiction. If you are located outside the United States and choose to provide information to us, the Services may transfer Personal Information to the United States where it is processed. Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer.

What are your choices?

You have choices about how we use your information, such as how we market to you or how we manage Cookies and Similar Technologies or Device Information.

We may use Targeted Advertising, at our discretion. What are your choices about how we directly market to you?

You can choose how you would like to receive direct marketing communications. If you choose to not receive marketing communications from us, we will honor your choice. We will still communicate with you in connection with your use of and access to the Services. You can also click unsubscribe on the bottom of e-mails

How can you update or delete your Personal Information?

Users of the Services can update their personal information through their “Profile”, which is accessible once a user has logged-in to the Services. To update an email address, you may click on the “Change Email Address” button available through your “Profile”. You will then be able to provide a new email address. In the event that your email address is changed, we will send you an email requiring you to confirm that your email address has changed.

If you completely delete all such information, then your account may become deactivated. If you would like us to delete your record in our system, please contact us and we will attempt to accommodate your request, however, we may have to retain a copy of some of your information for record keeping purposes.

What is the policy towards third-party links inside the Services?

Our Services may contain links to other websites, apps, and platforms. If you click on an ad or another third-party link, you will be directed to that third party's website, app, or platform. The fact that we link to a website or present a banner ad or other type of advertisement is not an endorsement, authorization or representation of our affiliation with that third party, nor is it an endorsement of their privacy or information security policies or practices. We do not exercise control over third party websites. These other websites may place their own cookies or other files on your computer, collect data or solicit personal information from you. Other sites follow different rules regarding the use or disclosure of the personal information you submit to them. We encourage you to read the privacy policies or statements of the other websites you visit.

Your California privacy rights

California Civil Code Section 1798.83 permits customers who are California residents to request certain information from us regarding our disclosure of personal information to third parties for their direct marketing purposes.
